These Terms and Conditions ("Terms") govern your use of ash.tf (the "Service"), a URL shortening service operated by Ashley Lavery ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

1.1 You must be at least 18 years old to use the Service.

1.2 You are responsible for keeping your login credentials secure and for all activity that takes place under your account. You must notify us immediately if you believe your account has been compromised.

1.3 You may be able to sign in using a third-party service, such as Google or GitHub. By doing so, you agree to the terms of that service and grant us permission to access your account information as necessary to provide the Service.

1.4 You must provide accurate and complete information when creating an account. You are responsible for maintaining the accuracy of your account information.

2. Acceptable use

2.1 You agree not to use the Service to create, store or distribute links to content, or to carry out activity, that:

  • is unlawful, fraudulent, or facilitates illegal activity;
  • distributes malware, viruses, or other harmful code;
  • is used for phishing, scams, or deception;
  • constitutes spam or unsolicited bulk messaging;
  • infringes the intellectual property, privacy or other rights of any person;
  • is defamatory, harassing, abusive, or threatening;
  • contains or links to child sexual abuse material or other content that is illegal to possess or distribute;
  • attempts to disguise the destination in order to mislead or harm visitors; or
  • otherwise harms or attempts to harm the Service, its users, or third parties.

2.2 You must not attempt to gain unauthorised access to the Service, disrupt its operation, circumvent rate limits or security measures, or use automated means to access it except as we expressly permit.

2.3 We may scan, review or check shortened links and destinations to detect and prevent abuse, and we may use third-party services to do so.

2.4 We are under no obligation to monitor all links, content, or activity on the Service.

2.5 If you believe a link created using the Service is abusive, illegal, or infringes your rights, please contact us at support@ash.tf.

3. Our rights regarding content and links

3.1 You retain any rights you have in content associated with destination URLs submitted through the Service. We do not claim ownership of such content. You grant us a limited, non-exclusive right to store, process and serve information necessary to provide the Service.

3.2 We may, at our discretion and without prior notice, disable, remove, or suspend any link or account that we reasonably believe breaches these Terms or poses a risk to the Service or others.

3.3 We are not responsible for the content of destination URLs. Shortened links may point to third-party websites that we do not control.

4. Availability and changes to the Service

4.1 The Service is provided on a best-efforts basis. We do not guarantee that it will be available, uninterrupted, or error-free.

4.2 We may modify, suspend, or discontinue the Service (or any feature, including specific links) at any time, including for maintenance or for operational reasons.

4.3 You should not rely on the Service for business-critical or safety-critical purposes.

5. Termination

5.1 You may stop using the Service and request deletion of your account at any time.

5.2 We may suspend or terminate your access at any time, including for breach of these Terms, on reasonable notice where practicable, or immediately where the breach is serious or there is a risk of harm.

5.3 On termination, your right to use the Service ends. We may disable or permanently delete links and associated account data in accordance with our Privacy Policy, subject to legal, security, fraud prevention, and backup retention requirements.

6. Disclaimers and liability

6.1 The Service is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law.

6.2 Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under English law.

6.3 Subject to clause 6.2, we are not liable for: loss of data, profits, or goodwill; any indirect or consequential loss; or any loss arising from your use of, or inability to use, the Service, or from the content of any destination URL.

6.4 If you are using the Service as a consumer, these Terms do not affect your statutory rights.

7. Indemnity

If you use the Service in the course of a business, you agree to indemnify and hold us harmless from claims, liabilities, damages, losses, and reasonable expenses arising from your breach of these Terms or your unlawful use of the Service, except to the extent caused by our own negligence or misconduct. This clause does not apply where you use the Service as a consumer.

8. Privacy

Our use of personal data is described in our Privacy Policy, which forms part of these Terms.

9. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date and, where changes are significant, take reasonable steps to notify registered users. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

10. Force majeure

We are not responsible for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including internet outages, denial-of-service attacks, failures of third-party providers, acts of government, natural disasters, labour disputes, or other similar events.

11. Severability

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect. Where possible, the invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

12. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us relating to your use of the Service and supersede any previous agreements, arrangements, or understandings between us relating to it. Nothing in this clause limits or excludes any liability for fraud or fraudulent misrepresentation.

13. Third-party rights

These Terms do not create any rights enforceable by any person who is not a party to them under the Contracts (Rights of Third Parties) Act 1999. This does not affect any right or remedy that exists independently of that Act.

14. Governing law and jurisdiction

These Terms and any dispute arising out of them are governed by the laws of England and Wales, and are subject to the exclusive jurisdiction of the courts of England and Wales.
